Divorce! not so fast….and in person…nopes

So apparently a woman was divorced by a man not her husband…how is that possible? apparently all you need is to be a follower of Shia Muslim Law and then do as Sabir Hussain did, send your buddy over to say the words ” Talaq” and Mumtaz has to let go, along with her three children to a 20 year old marriage. In another rural area of Northern India, the whole damn Panchayat  divorced the woman, from her husband Ahmed and the shocked Harunnissa hung herself.

SO  the Parliamentary Committee can now have more evidence to cite in support of the recently  passed proposal to amend marriage laws “to include “irretrievable breakdown of marriage” as a ground for divorce”.  They were diligent though and said make sure women are supported and adopted children and property divided….or something…. really? how many couples adopt in India? is this law for Indian couples or a revision of some Westernized law? oh wait…this is only applicable to Hindu Women..hai na? How about introducing divorce rights and pitfalls in the primary school curriculum…because there are so many laws in the country and most women don’t get more than primary education…so they can be prepared…Apparently, India’s divorce rates have doubled with 4 in 100 getting a divorce..from 11 out of 1000 and as men become more complexed, women more aware…really? so dowry demands should be down…dowry deaths should be down, and domestic violence should be down… but those numbers are static… and women in rural areas are they in the running to get a divorce…but men can use the new law of ”  “irretrievable breakdown of marriage” to never return to their village…maybe this is how new India equalizes playing field for men..why should Muslim men get to send an agent while a Hindu has to forbear…..get him the divorce too…

Even though the reasons for divorce and incompatibility according to research studies are still more alcohol abuse rather than women’s work or household work but when the law is western, designed for urban elite, why bother exploring the indigenous reasons…let’s support divorce and then we can learn from the west about  how to raise children minus community and family and the isolation and loneliness etc etc. etc…marriage, property, and divorce continue to be important determinants of women’s equality….but denial of women’s vulnerability and differences in their background will create laws that
benefit a few and take from many….the most important aspect of laws are its conditions and …that requires research…hmm who is going to do that? we are cool and almost European now! why should we wait “for our divorces…… “The parliamentary panel opposed doing away with the prevailing waiting period of six months before moving a joint motion for annulling marriage.” oh well at least some one did! maybe they read that divorce continues to be a strong predictor in suicide…..in India

So Mumtaz might not have dreamed of a Taj Mahal but divorce by a buddy….is probably not the nightmare  she had either …and not one with the helping hand of the law!
